the fault lies with the guy not on the flysurfer. right foot forward has right of way.

I would say both because the yellow kite because he went low but then turned up wind . But then agin if the cam dude would of put the kite low and not have stopped the yellow kite might of went hight and turn tight up wind to miss him.
