Just a note to anyone living in Passaic Morris and Bergen countys I've been having issues with law enforcement and land access to kite on public fields. Cops claim to not be able to argue for me since they dont even know the sport. Has a law been passed recently preventing us in NJ if so I would like to know because I have court soon with so Pastor who called the cops when I was snow kiting at a public park.

Trespassing, and endangerment which is funny because 1 it was public property had all rights to be there and 2 no one was around.

A fellow in Cali' fought and won and posted all about it here but I forget his name.

I think you are referring to Mike Dooley. His case was settled out of court so there is no record of it. I know because some of us have tryed to find a record of it and there is none.

Wow,,,,, .... I am very interested with this story .....
I kite sometimes in NJ parks.... and most of time I was able to avoid troubles .... except one time when I get almost arrested because someone call caps about me landing with parachute in park ....
... What you did ???? Static ? MTB ??
I never use buggy in the park ..... I was always afraid that would get me a ticket ....

You're going to have narrow things down further.

You can be considered Trespassing if the park has posted hours and you are there outside of those hours.

Then you need to determine whether kiting was disallowed there.

State Laws get trumped by Town/City ordinances which get trumped by park rules. So any one or a combination of them could have tripped you up.

I don't believe other people have to be present for a public endangerment citation. I know that seems counter-intuitive, but it's to cover cases like where a beach starts out empty, and even once it starts filling up, a kiter that was there before the crowds won't flag out his kite.

Of course, it's also possible the cop was the Pastor's nephew.

Went to court won the case and I was just skiing, I now have been emailing owners of the properties or supervisors such as Board of Ed. PD and print out emails with permission and keep them in my car. But I am soon upgrading from my 5m to an 11m fuel. :)

I was buggying in a park in Houston, TX, a few years ago. I just happened to not be on my buggy when a cop drove by and started talking to me. I asked if it was OK to fly my kite in the park. He said, "Yes, but I had better not see you riding that thing." (obviously referring to the buggy) I didn't ask him why, but I wish I had because I think about it often. I don't know if he thought that it was self propelled or not. Maybe he thought it was some small go-cart. I was just thinking about this situation and thought about posting it during the last few days. It's funny how this thread came up at the same time.

I was buggying in a park here in N Ga, and saw property management roll up (the guy picking up the trash). I checked with him if it was ok and he said that the park rules stated that there were to be no "motorized vehicles" in the field and (insert country accent here) "looks like that thing's pulled by a kite"

Further he stated that if the park were more crowded it'd be an issue, but since it wasn't it was ok.

I make sure to make nice nice and wave to him when he drives by in his p/u now.

Jason, which park in Houston were you buggying in? I have yet to find a park that has big enough area clear off trees...

It was one near Lake Houston in Humble, but the field wasn't big. The best I have found is Walter Hall park in League City. It has a field that is at least 400 x 700 feet and has few trees around it. I have never had anyone competing with me for space.

Dude I forgot what happened with the ticket its still sitting in my glove compartment I got a parking ticket on top of that.
