Here is the short of it, and im going to try and be as concise, and "un-a$$hole" as i can, because i hate it when people come down on vendors in this forum... but i honestly believe ive exhausted all my options, in terms of keeping this a private matter... a few people have offered to help, and ive politely turned them down for a while now... but now, its time... if you can help, id appreciate it.

I purchased a GoproHD from Corey at Windpower Sports four months ago tomorrow. After placing the order, i recieved no contact. I called and talked to Corey, he said it'd be in my hands at JIBE... That he'd send it to Angus. No camera, no contact. At the time of the call, he said email was his preferred method of contact. So i decided to email him about it. Several weeks went by, and no emails. Ive called him three times since this whole thing started, and each time, i was told the camera wasnt in, but was expected in by the end of the week, or early the next, and would def be shipped... but i havent seen anything.

As far as the preferred method of communication, email... i have only seen one email in four months, and that was the auto confirmation from his site.

To anyone that knows Corey, i just want my camera, or a refund. I know he's had some family issues this year, and gopro can be a PITA to deal with (so ive heard from a few vendors) so i cant fault him there. But c'mon, at four months i should have something to show for the $300 hole in my bank account.

Im not trying to slam corey or tell him how to run his business, or affect your choice in vendors.... i just want my camera, or my money..... I dont think thats too much to ask.

Im sorry to take this to the boards.... i REALLY hate that it came to this, but after my last two emails, asking for contact, then a refund, i feel like he has just completely blown me off.

So if you talk to corey regularly, or see him often enough, or you are a good friend of his... just ask him on my behalf if he could send me my camera, or give me a refund....

Drew, it's not your fault that you had no other recourse but to go public with this. You handled it in a most mature manner and I applaud you for going this distance without doing so sooner. There is always 2 sides to a story, but it's hard to justify no contact and no goods for payment received after 4 months. Heck, I was barely unpacked from NABX when you placed the order. Since then, I've sold a house, lived in a hotel for a month, bought a house and moved into it, with a 2 week vacation thrown in there. It's time you got some resolution.

Four months? Wow, that's a long time to wait. You're a much nicer guy than I am. I have a general rule that I almost always follow: if I don't receive the goods I've ordered by the time I my credit card payment's due or if I don't know for an absolute fact that it's on its way to me, I file a chargeback with the credit card company. I've only had to do it a few times but I've never regretted doing it. Vendors who are so slow to deliver a product that they can't even get it out the door during the period of one billing cycle are almost always companies you'd be better off not doing business with. It also works the other way as well, as soon as I receive confirmation of payment from someone, I ship the item and email them a tracking number. I do my best to give people the same kind of service that I expect when I'm the buyer. I'm happy to say that just about everyone here at PKS is just like me in that regard.

In your particular situation the fact that you waited so long is going to hurt your chances of getting what you want. You can still contact the BBB for the state where the vendor is located, I've done that once for a company in California and they actually followed up on the case. You can also contact the USPS Inspector General's office as well as your credit card company and the State Attorney General's Office. If you rattle this vendor's cage enough you might end up winning, but if not you'll at least have the satisfaction of getting his attention.

i dont want to hurt the guys business... corey is big in the kite world, and he does a lot to further the sport... i really just want my camera, and ill go on my way. I still have faith in the guy, and i really think he just keeps forgetting about me... I have "OOO shiny object!" syndrom bad so i know how it goes.

I hoping this reminder and a few nudges from some peeps does more than my emails and calls.

I used paypal, so if it comes to that, i can prolly get my money back there, paypal is good about things like that.


Thanks for the encouragement everyone.... i was gearing up for a backlash as soon as i posted this.... im relieved it didnt go that route.... this just bugs me SO much to post this... but i feel like im getting the shaft, so to speak, and thats not my favorite feeling

You posted a calm and concise summary of your side of the story, it was not a flamefest burn someone at the stake, for that I commend you and am betting that is why you are not getting flamed in return.

I also would not have waited quit so long. After 90days your really at the point of no return, you may want to check with paypal about thier time limitations for disputes.

I have no knowledge of the seller or even item, but working in sales myself, I can also see that potentially he is "hung out to dry" as well. He may have had the order in since you ordered and the vendor/mfg is just not shipping product. He is likewise out the $ and frustrated. But I think that after 60days and no product inhand to send you, the "right thing" to do would be credit/refund to salvage the situation and customer as best possible in a bad situation.. Worst case he ends up recieving the unit the next day and can call you that it is inhand, or have it on his shelf to sell to the next person since they are so hard to find..

I wish you both luck and a that you reach an amicable solution for all involved.

you nicer than i am, too... i think most legal solutions must be pursued within 90 days... its very easy to get your money back from a credit card company, or even paypal... but now that the cutoff has expired, you may have to settle for just not getting your gear...

next time, wait no more than 6 weeks is what i might advise...
