I don't know anything about the Apex but think that an Apex II may be out soon so you may want to wait for one of those if you go that route. Or wait
until they come out so that any leftover Apex I's go on sale.
I think that 5m would be a nice size for a first depower because you could probably hold onto it for a high wind kite once you've progressed.

The Apex is a great kite but the new models are coming out soon. You may want to wait a little to try and snag a closeout if you want to save a
little or wait and spend the cash on the newer model.
The Apex is the lower aspect ratio kite to the Montana. Usually a little more affordable and usually little less performance than the Montana kites.
The Apex was released to compete against Ozone's Access kite which happens to be the kite under the Frenzy. It is a fantastic kite but to be honest
with you, I much prefer the increased performance on the Montana or Frenzy over the Apex or Access. The Montana will have much more lift and
hangtime. You may find yourself wanting to upgrade to the Montana once you master the Apex.
That being said, we do have our Montana III's on closeout right now to make way for next years model which should be out in the next month or so.
I have one 5.0 meter left in stock and I heard that the 5.0 was not going to be offered next year....I will need to double check that to be sure tho.
Hope this helps.

I also suspect that the Montana would be an easier kite to resell if you decided to upgrade later on. They seem more popular than the Apex's anyway.
If you've got a shop within an hour or two where you can get a demo on the Apex or preferably the Apex and Montana that would be the way to go.

I second, go with Montana. Should be able to get a good deal on Montana3 because M4 is out
The M3 will not be a kite that you outgrow. I demoed the 9.5 last winter. Very comparable to Frenzy
